What Are Guardianships and Conservatorships?

When someone is not competent and cannot handle his or her own affairs, usually due to advancing age or a degenerative medical condition, a guardianship or conservatorship grants someone else the right to make financial and medical decisions for that person.

Situations requiring guardianships and conservatorships commonly arise when:

  • Someone does not have a health care power of attorney in place and no longer has the capacity to create power of attorney, or

  • The person who was given financial power of attorney is taking advantage of the incompetent party's finances.

What Is the Difference Between a Guardianship and a Conservatorship?

Guardianships: These help in situations where a person is unable to competently make decisions about his or her medical care. Many times, placement in a nursing home or hospital requires a guardianship or power of attorney to be in place before someone can be checked in to the facility.
Conservatorships: These are almost identical to guardianships, but deal with a person's finances instead of medical decisions.

In order to obtain a guardianship or conservatorship, you must go through the courts. After a guardianship or conservatorship is granted, each year you must re-file your request with the court and give the court a status update about how the person and his or her finances are doing.
